1. GENERAL PROVISIONS

1.1 Applicability

These General Terms and Conditions apply to all sales of goods and services by Brasserie Taymans Brouwerij SPRL (Brasserie Taymans Brouwerij), including but not limited to product sales, brewery tours, events, and Ambassador Club memberships. The buyer formally acknowledges submitting to our general conditions of sale, compliance with which is considered by us to be an essential element of any contract. Consequently, unless waived, any purchase conditions of the buyer are deemed unwritten.

1.2 Governing Law

In the event of a dispute, only the courts and tribunals of Brussels will be competent. These terms are governed by Belgian law.

2. SALES OF GOODS

2.1 Orders and Pricing

All orders are subject to product availability. The price you pay is the price displayed when you complete your purchase - this price is guaranteed and won't change after you've paid. We may adjust our prices from time to time, but these changes only apply to future purchases.

2.2 Delivery

The delivery date is only mentioned as an indication. Brasserie Taymans Brouwerij commits to fulfilling orders as soon as possible. Unless expressly stipulated, damages or cancellation of order for late delivery will not be accepted. All shipments are handled by BPost with standard tracking provided. Insurance for high-value orders is available upon request. Risk of loss or damage passes to the buyer upon delivery by BPost.

2.3 Payment Terms

All invoices are due immediately upon receipt unless otherwise specified in writing. For late payments, the following charges will apply:

After 30 days: A late payment fee of 5% of the invoice amount (minimum €15) will be automatically applied
After 60 days: An additional interest charge of 8% per annum will accrue on the outstanding balance
Payment reminders will be sent at 14 and 28 days to help avoid late fees
We reserve the right to suspend further deliveries or services until outstanding balances are settled

2.4 Complaints

Any complaint concerning a supply or an invoicing must reach Brasserie Taymans Brouwerij, within 5 business days following the date of the invoice.

2.5 Retention of Title

The goods remain our property until full payment of the invoice. The risks are borne by the buyer. Deposits may be retained to cover any losses on resale. In the event of resale of the goods, even transformed, belonging to the seller, the buyer hereby assigns to him, as a pledge, all claims resulting from their resale.

3. AMBASSADOR CLUB MEMBERSHIP

3.1 Membership and Benefits

The specific benefits, pricing, and allocations for each membership are detailed in the current Ambassador Club Benefits Guide, which will be provided to prospective members before purchase and confirmed via email upon membership registration. Benefits typically include but are not limited to exclusive bottle allocations, branded merchandise, event access, purchase discounts, and tier-specific experiences. Bottle allocation schedules, delivery terms, and shipping costs are specified in the Benefits Guide and may vary by location and tier.

3.2 Membership Duration and Renewal

All Ambassador Club memberships are valid until December 31 of the year following the date of purchase, providing a minimum of 12 months and maximum of 23 months of membership depending on purchase date. For example, memberships purchased anytime in 2025 expire December 31, 2026. Memberships are renewable annually for the subsequent calendar year. Members will receive renewal notifications 30 days before expiration on December 1st. Renewal must be completed by January 14 to maintain continuous membership benefits and seniority. Lapsed memberships beyond January 14 will be treated as new memberships.

3.3 Purchase Limitations and Discount Terms

To ensure fair distribution among all Ambassador Club members, purchase limitations and discount percentages vary by membership tier and are specified in the Ambassador Club Benefits Guide. Purchase limits apply to all Brasserie Taymans Brouwerij products combined. Limited edition releases may have specific per-member allocations that supersede annual limits. The included bottles in membership packages do not count toward purchase limits. All membership discounts are exclusively for the named member and are non-transferable. Discounts only apply for purchases done directly at the brewery. Members must present valid membership card or digital proof for discount redemption. Discounts apply to beer purchases only, not merchandise or events unless specifically stated. Discounts cannot be combined with other promotions or offers. Specific limits per tier will be confirmed in your membership welcome email.

3.4 Membership Obligations

Members agree to provide accurate and current contact information, respect the brewery's heritage and facilities during visits, not resell membership benefits or exclusive products for commercial purposes, comply with responsible consumption guidelines at all events, respect photography and social media policies during exclusive events, and maintain a valid email address for digital benefits delivery. Failure to comply may result in termination of the member’s membership rights.

3.5 Cancellation and Refunds

Memberships are non-refundable once activated. Benefits are non-transferable to other individuals. In case of membership cancellation by Brasserie Taymans Brouwerij due to violation of terms, no refund will be provided. Unused benefits do not carry over to the following membership year.

3.6 Exclusive Events

Participation in exclusive events is subject to availability and RSVP. The yearly exclusive launch event is included in all membership tiers with guest privileges varying by tier as specified in the Benefits Guide. Tier-specific events and privileges are detailed in the Ambassador Club Benefits Guide. Some events may require additional fees beyond membership. Members must be 18 years or older to participate in tasting events. Brasserie Taymans Brouwerij reserves the right to modify event schedules with 14 days notice.

3.7 General Provisions

Membership tiers may have capacity limits and once reached, a waitlist system applies. Brasserie Taymans reserves the right to modify or substitute benefits of equal or greater value with 30 days notice to members. Core benefits comprising bottle allocations and discount percentages remain guaranteed for the membership period. Lost membership cards may be replaced for a fee of €10. International members may have modified benefits due to shipping restrictions and regulations. All benefits are subject to availability and regulatory compliance.

4. SALES OF SERVICES

4.1 VAT

The services offered by Brasserie Taymans Brouwerij are subject to 21% VAT.

4.2 Liability

Brasserie Taymans Brouwerij and its partners have taken out the necessary insurance as group leaders and guides for the activities they offer. However, they cannot be held responsible for accidents or other damage occurring during their services in the event of negligence, failure to follow instructions or inappropriate conduct on the part of their clients. If the guide's instructions are not followed, he or she has the right to interrupt or stop the activity, with no possibility of legal action or compensation for the client.

4.3 Minors

Minors must be accompanied by an adult. Their participation is under the full responsibility of the parent or accompanying adult. Under no circumstances may the guide be considered as supervising children, nor as responsible for them within the meaning of article 1384 al. 2, 4 or 5 of the Belgian Civil Code.

4.4 Equipment

All equipment made available to customers during activities remains the exclusive property of Brasserie Taymans Brouwerij or its partners. The customer undertakes to treat the equipment provided with due care. He/she is responsible for any damage caused to the equipment made available to him/her throughout the duration of the activity. Parents are responsible for any damage to equipment loaned to their minor children.

5. PRIVATE GROUP BOOKINGS

5.1 Reservations

The reservation of services for private groups is confirmed by email from Brasserie Taymans Brouwerij. The customer confirms the agreement by email. The reservation is definitively confirmed after payment of the total amount including VAT.

5.2 Payment

A global invoice is sent to the customer by email before the service. The total amount (including VAT) must be paid in full to confirm the reservation. All bank charges are at the customer's expense. Brasserie Taymans Brouwerij does not accept payment by cash or cheque.

5.3 Modifications

Any modification must be communicated as soon as possible by email to Brasserie Taymans Brouwerij, with reference to the order form number, and no later than 7 calendar days before the date of the service. After validation, we will not make more than one change without charging an administrative fee of €50 excluding VAT per change, plus any charges levied by our service providers.

5.4 Cancellations

In the event of cancellation, the customer must notify Brasserie Taymans Brouwerij as soon as possible by email. Unless otherwise agreed, Brasserie Taymans Brouwerij will invoice:

30 calendar days or more before the event: €50 administration fee, excluding VAT
Between 29 and 8 calendar days before the event: 50% of the total cost including VAT, minimum €50 excluding VAT
7 calendar days or less before the event: 100% of the total cost, including VAT

6. Privacy & Data Use

Brasserie Taymans Brouwerij processes personal data in line with applicable laws and uses it solely for managing Ambassador Club memberships, event invitations, and brewery communications. 7. DIGITAL AUTHENTICITY & NFTs

7.1 NFT Certificates of Authenticity

Brasserie Taymans Brouwerij may issue Non-Fungible Token (NFT) certificates to guarantee authenticity for certain items including but not limited to:

Barrel naming rights for eligible members
Limited edition bottles
Special brewery memorabilia
Exclusive event attendance certificates

7.2 NFT Terms

NFTs are provided as proof of authenticity and ownership record only
NFTs do not grant additional rights beyond those specified in the membership tier
Brasserie Taymans Brouwerij is not responsible for blockchain network fees, wallet management, or technical issues related to NFT storage
Members are responsible for maintaining access to their digital wallet
Lost access to NFTs does not void physical benefits or membership rights
NFTs may be issued on a blockchain platform of Brasserie Taymans' choosing

7.3 Transfer and Trading

NFTs proving barrel naming rights are non-transferable and tied to the named member
Limited edition bottle NFTs may be transferred with the physical bottle
Commercial trading of membership NFTs is prohibited
Transfer of NFTs does not transfer membership benefits

8. FORCE MAJEURE

Brasserie Taymans shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, pandemic restrictions, government regulations, or supply chain disruptions.

9. AMENDMENTS

Brasserie Taymans Brouwerij reserves the right to modify these terms and conditions at any time. Members will be notified of substantial changes 30 days in advance. Continued membership after notification constitutes acceptance of the modified terms.
