Terms & Conditions

Sales of goods:

  1. Our offers are made without engagement, subject to the state of our stocks. The prices invoiced are those in force on the day of supply.
  2. The buyer formally acknowledges submitting to our general conditions of sale, compliance with which is considered by us to be an essential element of any contract. Consequently, unless waived, any purchase conditions of the buyer are deemed unwritten.
  3. The delivery date is only mentioned as an indication. The Brasserie La Confluence is held there as soon as possible. Unless expressly stipulated, damages or cancellation of order for late delivery will not be accepted.
  4. Goods are shipped at the recipient's risk.
  5. All our invoices are payable in cash on the dates indicated therein. The acceptance of drafts does not constitute a derogation from this rule, nor an innovation.
  6. If our invoices are not paid on the date indicated, the amounts are increased automatically and without further formal notice, by an amount of 15% with a minimum of 37.18 euros, as damages. In addition, it is expressly agreed that sums not paid on their due date earn interest of 12% per annum.
  7. Any complaint concerning a supply or an invoicing must reach us in writing at the company, within 5 days following the date of the invoice.
  8. The goods remain our property until full payment of the invoice. The risks are borne by the buyer. Deposits may be retained to cover any losses on resale. In the event of resale of the goods, even transformed, belonging to the seller, the buyer hereby assigns to him, as a pledge, all claims resulting from their resale.
  9. In the event of a dispute or dispute, only the courts and tribunals of Brussels will be competent.

Sales of services:

  1. The services offered by Brasserie Taymans Brouwerij are subject to 21% VAT.
  2. La Brasserie Taymans Brouwerij and its partners have taken out the necessary insurance as group leaders and guides for the activities they offer. However, they cannot be held responsible for accidents or other damage occurring during their services in the event of negligence, failure to follow instructions or inappropriate conduct on the part of their clients. If the guide's instructions are not followed, he or she has the right to interrupt or stop the activity, with no possibility of legal action or compensation for the client. In the case of an activity offered to individuals, if the guide decides to interrupt the activity for the above-mentioned reasons, the persons responsible for the interruption will be obliged to reimburse the price paid by the other participants not responsible for the interruption of the activity.
  3. Minors must be accompanied by an adult. Their participation is under the full responsibility of the parent or accompanying adult. Under no circumstances may the guide be considered as supervising children, nor as responsible for them within the meaning of article 1384 al. 2, 4 or 5 of the Belgian Civil Code.
  4. All equipment made available to customers during activities remains the exclusive property of La Brasserie Taymans Brouwerij or its partners. The customer undertakes to treat the equipment provided with due care. He/she is responsible for any damage caused to the equipment made available to him/her throughout the duration of the activity, whether caused by him/herself or by others. Parents are responsible for any damage to equipment loaned to their minor children.
  5. Brasserie Taymans Brouwerij reserves the right to modify its prices and general terms of sale at any time. However, products or services are invoiced on the basis of the rates and conditions in force at the time of purchase or issue of the order form.
  6. Reservations, modifications and cancellations for private groups :
    1. As a private group, the reservation of a service and the setting up of a tailor-made program are made on the basis of a request from the customer and discussions between the latter and La Brasserie Taymans Brouwerij.
    2. The reservation of the service is confirmed by email from La Brasserie Taymans Brouwerij. The customer confirms his agreement by email to La Brasserie Taymans Brouwerij. The reservation is definitively confirmed after payment of the total amount including VAT.
    3. A global invoice is sent to the customer by email before the service. The total amount must be paid on receipt of the invoice.
    4. The reservation is definitively confirmed after payment of the total amount including VAT.
    5. Invoices will not be sent by post unless expressly requested by the customer at the time of confirmation and prior to the event. All bank charges are at the customer's expense. Brasserie Taymans Brouwerij does not accept payment by cash or cheque.
    6. The service is fixed and priced according to the number of participants specified at the time of booking. Should this number change, La Brasserie Taymans Brouwerij and its partners cannot guarantee either the schedule or the advertised price. The price may be adjusted upwards or downwards to reflect the new situation.
    7. Brasserie Taymans Brouwerij and its partners will do their utmost to respect what has been agreed and validated by the offer. However, the schedule may be subject to change for reasons beyond our control. We cannot guarantee that everything agreed will be respected in the event of delays on the part of the customer. In the event of long delays, certain activities may be cancelled without any right to reimbursement or compensation.
    8. The service is fixed by mutual agreement between the customer and Brasserie Taymans Brouwerij. Any modification made by the customer must be communicated as soon as possible by email to Brasserie Taymans Brouwerij, with reference to the order form number, and no later than 7 calendar days before the date of the service. La Brasserie Taymans Brouwerij will do its utmost to take into account any changes requested by the customer, but cannot guarantee that the requested changes will be carried out. After validation of the order form, we will not make more than one change without charging an administrative fee of €50 excluding VAT per change, plus any charges levied by our service providers (unless otherwise agreed). Except in the case of duly justified force majeure (death of a close relative, birth of a child, hospitalization, air travel problems, long-distance transport strikes), no changes will be accepted less than seven calendar days before the date booked (unless otherwise agreed).
    9. In the event of cancellation, the customer must notify La Brasserie Taymans Brouwerij as soon as possible by email, quoting the order number. In order to cover the costs incurred and unless otherwise agreed, the Brasserie Taymans Brouwerij will invoice:
      1. 30 calendar days or more before the date of the event: €50 administration fee, excluding VAT.
      2. Between the 29th and the 8th calendar day before the date of the service: 50% of the total cost including VAT, with a minimum of €50 excluding VAT.
      3. 7 calendar days or less before the date of the service: 100% of the total cost, including VAT.
